    “We predicted that it would be only a matter of time before someone produced fake COVID vaccine cards.

    A California woman has become the first person in the country to face federal charges over coronavirus vaccine cards.

    Juli A. Mazi, 41, of Napa was arrested Wednesday and charged with one count of wire fraud and one count of false statements related to health care matters, the Department of Justice said in a press release.

    “This defendant allegedly defrauded and endangered the public by preying on fears and spreading misinformation about FDA-authorized vaccinations, while also peddling fake treatments that put people’s lives at risk. Even worse, the defendant allegedly created counterfeit COVID-19 vaccination cards and instructed her customers to falsely mark that they had received a vaccine, allowing them to circumvent efforts to contain the spread of the disease,” said Deputy Attorney General Lisa O. Monaco.

    Given that this is California, Legal Insurrection readers will likely not be surprised that Mazi is a “naturopathic doctor.” She offered fake “homeoprophylaxis immunization,” so Mazi is also charged with offering counterfeit vaccines.

    Federal officials say Mazi was selling “homeoprophylaxis immunization pellets,” which involve exposing someone who consumes them to a diluted amount of a disease in hopes of triggering an immune response. Prosecutors said she falsely claimed the pellets contained a minute amount of the COVID-19 virus and that the pellets would confer “lifelong immunity.” She also falsely told patients that the approved vaccines against COVID-19 contained “toxic ingredients.”

    She also reportedly told patients that the treatment would be effective on children as well — even babies.

    The homeoprophylaxis immunization treatment is not authorized by federal health officials to fight COVID-19. There is currently no approved vaccine for anyone under the age of 12.

    Mazi should be worried about the Federal Bureau of Investigation’s involvement in the case. The agency is likely to take harsh measures for citizens challenging the federal government narrative on its key policies.”

    President Biden’s pick to head the civil rights division under the Department of Education (DOE) testified Tuesday that she would uphold a Trump-era Title IX regulation even though she claimed it lets students “rape and sexually harass students with impunity.”

    Title IX is the 1972 law barring discrimination based on sex in education and has been the center of heated debate over penalties for students accused of sexual misconduct at universities across the U.S.

    During Catherine Lhamon’s Senate confirmation hearing Tuesday, Sen. Bill Cassidy, R-La., questioned her about a previous statement in which she criticized Title IX regulations implemented by former President Trump’s Education Secretary Betsy DeVos.

    Lhamon defended a May 2020 tweet, claiming that the Trump-era Title IX regulations allow students to “rape and sexually harass students with impunity.”

    Lahmon doubled down on her previous statement answering, “I think what I said in the tweet, the regulation permits students to rape and sexually harass with impunity. I think that the regulation has weakened the intent of Title IX that Congress wrote.”

    Is it a good idea to put someone who believes students will “rape with impunity” in charge of civil rights in education? Lhamon is a radical.”

    “Usually when a migrant is picked up at the border and makes a claim of asylum, the border patrol processes those claims and gives the migrants a “notice to appear” in a specific court at a specific time. But back in April the Associated Press reported that because of the big surge of migrants at the border, many were being released into the interior of the country with just an instruction which told them to report to an ICE facility within 60 days for processing:

    The Border Patrol began the unusual practice last week in Texas’ Rio Grande Valley, which has seen the biggest increase in the number of migrant families and unaccompanied minors crossing the border. Last week, the agency added instructions to report to an ICE office within 60 days to adults’ booking documents…

    Customs and Border Protection, which oversees the Border Patrol, said it stopped issuing court notices in some cases because preparing even one of the documents often takes hours…

    Migrants will be issued notices to appear in court at their 60-day check-ins with ICE, according to a U.S. official with direct knowledge of the plans who spoke on condition of anonymity because the plans have not been made public. It is unclear how widespread the practice has been, but it is very common in Rio Grande Valley, the busiest corridor for illegal crossings.

    So the idea was to clear out the border holding facilities as quickly as possible because they were overloaded. Instead of doing the time consuming work to process migrants on site, they would get the instructions about showing up at an ICE facility within 60 days at which point they would be processed and receive the usual notice to appear in court. It has been more than 60 days since this process began so how do you imagine it’s going? If you guessed that it has been a complete failure, you’re smarter than the Biden administration:

    Rep. Henry Cuellar, Texas Democrat, said in mid-April that 15,300 people had been released without notices to appear. A Washington Times source said in early May that the number was 18,000. Mr. Lankford said on May 13 that the number he had been told was 19,000….

    Taking Mr. Cuellar’s figure of 15,300 — all of whom are now outside the 60-day check-in window and should have turned up — the 3,446 who did show would be a compliance rate of 23%.

    Using Mr. Lankford’s 19,000 figure would put the compliance rate even lower, at 18%.

    Whatever the exact figure, it seems to be very much at odds with what Sec. Mayorkas told Senators during congressional testimony in May:

    “I can get that number to you because we have seen a high rate,” Mr. Mayorkas replied. “I should say that individuals who do not appear are a priority of ours for apprehension in the service of border security.”

    Two weeks later, testifying to the Senate Appropriations Committee, he was again prodded on appearance rates and was bullish on how things were playing out.

    “The appearance rate thus far, in terms of appearing at an ICE facility to report, has been very, very high, and I would be pleased to provide you with data,” Mr. Mayorkas said.

    In theory, ICE could go out and try to track down these illegal immigrants who never reported in as instructed. But in reality, the Biden administration has been clamping down on action by ICE such that the number of arrests is down by 60 percent.”

    “A judge on Thursday rejected the Arizona Senate’s motion to dismiss a public records lawsuit relating to its independent full audit of ballots cast in Maricopa County in the 2020 election.

    The lawsuit was filed by watchdog group American Oversight and sought records of communications between Senate officials and external vendors working on the audit, including Florida-based cybersecurity firm Cyber Ninjas, a private company hired by the Arizona Senate to oversee the audit of Arizona’s most populous county. It also sought documents related to the cost of the audit, donor information, and its operations.

    “It is difficult to conceive of a case with a more compelling public interest demanding public disclosure and public scrutiny,” Judge Michael Kemp of the Arizona Superior Court in Maricopa County wrote in a seven-page ruling (pdf).

    Kemp said that he “completely rejects” the arguments presented by the defendants’ lawyers.

    “Nothing in the statute absolves Senate defendants’ responsibilities to keep and maintain records for authorities supported by public monies by merely retaining a third-party contractor who in turns hires subvendors,” Kemp wrote.

    Keeping the election audit records private “would be an absurd result and undermine Arizona’s strong public policy in favor of permitting access to records reflecting governmental activity,” the judge said in his decision.”

Tychicus — that’s just common sense; you don’t want a third party private contractor who in then turn subcontracts some of the work conducting an audit of votes without a publicly accessible paper trail. Third party companies have to be as if not more transparent than the gov’t when it comes to counting votes. Would you like Google counting everyone’s votes in secret.

    The problem for Cyber Ninjas is we already know there’s no paper trail and chain of custody has not been observed.

  7. AJ — You will be happy to know that the Ontario gov’t quietly deleted a paragraph to the preamble to the math curriculum after the Toronto Sun published it. Apparently the premier is upset with the Education Minister for not reading the curriculum and flagging the questionable paragraph before signing it. The usual groups are upset but most teachers are amused that the Minister didn’t do his homework.

    The problem I’ve read concerning campus rape and assault is the legal grey zone that exists in university campuses. Despite being public institutions, universities are given lots of leeway in civil and criminal matters that occurs on campus part of a long tradition of academic autonomy. This has allowed universities to bury complaints before they reach regular law enforcement. DeVos gave all the power back to the universities even in cases of rape and sexual assault. There has to be a balance between academic autonomy, private property rights and protecting students.

    Latest numbers do suggest an increase in Covid cases in the US, in particular, Florida. Texas and California are the next states. With vaccination rates hovering at 50% and not improving, a surge in cases is to be expected. Note, with ever succeeding wave, the virus appears more contagious yet less deadly.

    Governments and employers have long demanded medical requirements for work and school. Students must have childhood vaccine records when enrolling for kindergarten. Workplaces have various rules regarding vaccines and tests especially if private health insurance is involved. Adding covid vaccines to this list changes nothing.

    The American Idea is just that an idea — its not something that has happened and you need to fight to preserve it. In fact in recent decades there’s been a decline in realizing the American Idea. Income mobility has declined — you are far more likely to do better than your parents in Nordic countries than in the US. Censorship and government surveillance has been commonplace in the post WWII era — just ask any leftist. History also tells use that the American Idea has racial limitations. When Cubans or other groups fly an American flag — its the idea they want not the reality. Ask if they want to given up universal free education and health care, and they would probably say no.

    I don’t think the reporter was out of step with ordinary Americans in terms of abortion. The vast majority of Americans occupy a waffling middle ground when it comes to abortion rights — they want Roe vs Wade to stay but they approve and disapprove of certain limitations.

  11. The FBI has become more reluctant with political figures since the fiasco with Clinton in the 2016 election. Now they are holding back until their work has not political consequences. Trump family and businesses are now being investigated for events in the last four years by the FBI. They held back until the election was over. I’m surprised they’re not waiting on Hunter until 2024.

    If a jetliner crashed everyday, America would panic. And if all they needed to do was wear a mask and take a vaccine to prevent the jet from crashing, I would think and hope Americans would do it.
