    “Supreme Court to hear case over Trump excluding illegal aliens from counting for congressional apportionment

    Argument November 30. Issue presented: “Whether the Memorandum is a permissible exercise of the President’s discretion under the provisions of law governing congressional apportionment.”

    “The Supreme Court just announced that it will hear a case involving the Trump administration’s plan to exclude illegal aliens from counting for the purpose of congressional apportionment.

    The government filing challenges lower court injunctions, and provided in part:


    Congress has provided that, for purposes of apportioning seats in the House of Representatives, the President shall prepare “a statement showing the whole number of persons in each State * * * as ascertained under the * * * decennial census of the population.” 2 U.S.C. 2a(a). It has further provided that the Secretary of Commerce shall take the decennial census “in such form and content as he may determine,” 13 U.S.C. 141(a), and shall tabulate the results in a report to the President, 13 U.S.C. 141(b). The President has issued a Memorandum instructing the Secretary to include within that report information enabling the President to implement a policy decision to exclude illegal aliens from the base population number for apportionment “to the maximum extent feasible and consistent with the discretion delegated to the executive branch.” 85 Fed. Reg. 44,679, 44,680 (July 23, 2020). At the behest of plaintiffs urging that the exclusion of illegal aliens would unconstitutionally alter the apportionment and chill some persons from participating in the census, a three-judge district court declared the Memorandum unlawful and enjoined the Secretary from including the information in his report. The questions presented are:

    1. Whether the relief entered satisfies the requirements of Article III of the Constitution.
    2. Whether the Memorandum is a permissible exercise of the President’s discretion under the provisions of law governing congressional apportionment.

    In an Order accepting the case and ordering expedited briefing and oral argument on November 30, the Supreme Court ordered:

    Further consideration of the question of jurisdiction is postponed to the hearing of the case on the merits. The case is set for argument on Monday, November 30, 2020. Appellants’ brief on the merits, and any amicus curiae briefs in support of appellants or in support of neither party, shall be filed on or before Friday, October 30, 2020. Appellees’ briefs on the merits, and any amicus curiae briefs in support of appellees, shall be filed on or before Monday, November 16, 2020. The reply brief shall be filed by 2 p.m., Monday, November 23, 2020.”

    “Pennsylvania has cast off hundreds of thousands of applications for mail-in ballots ahead of the 2020 election, because of confusion about the process.

    About 372,000 requests were rejected, as reported by ProPublica on Friday, largely because many of them, about 90%, were duplicates. Overall, one out of every five requests for mail-in ballots are being rejected, according to the publication.

    The main reason? Many people who voted during the June primaries may have already checked a box to request a mail-in ballot for the November election.

    However, people who made more than one request should eventually receive their ballot, a spokesperson for the Pensylvania State Department said. They can also head to the polls on Election Day.”

    “The Honest Elections Project is warning that recent events unfolding in states throughout the country have confirmed their fears that November’s election will be mired in controversy because states changed their voting procedures without adequate time to develop a workable system.

    The group had warned in a July report that large-scale voting by mail would waste resources, create a risk of complications, such as fraud.

    “Almost everything we warned of, happened in multiple states throughout the primaries,” a new addendum to the report says. “Rather than learn from these mistakes, many states are repeating them.”

    The addendum points to lawsuits filed by liberal groups to force states into changing ballot deadlines that could result in late ballots being counted, and counting others that could otherwise be invalid. One such case is awaiting a decision by the Supreme Court.

    Groups are also challenging election security laws such as witness requirements and prohibitions on ballot harvesting, which the Honest Elections Project claims could result in confusion and a lack of confidence in the election results.

    “Uncertainty and last-minute rules changes amplify the risk of delay and post-election litigation that could drag on for weeks, cast doubt on the election’s outcome, and possibly force states to miss the deadline to participate in the Electoral College, disenfranchising millions,” the group said.”

    Former Obama-Biden administration speechwriter among questioners at ABC town hall”

    “Two of the questioners at the ABC town hall featuring Democratic presidential candidate Joe Biden on Thursday had ties to high-profile Democrats, including one questioner who previously worked as a speechwriter in the Obama administration.

    The queries came as President Trump, hundreds of miles away, was engaging in his own parallel town hall being aired on NBC. The ABC town hall was hosted by George Stephanopoulos, who was a communications director for the Bill Clinton White House and who has been a political journalist since 2002.

    One of the questioners at the ABC-hosted event was Nathan Osburn, a former speechwriter for the Obama White House. Osburn specifically worked for the Office of Public Affairs at the Commerce Department under the Obama-Biden administration and at the Small Business Administration.

    Osburn’s profession was listed as “communications” on the ABC town hall graphic and his city was listed as Philadelphia, Pennsylvania.

    Osburn was quoted in the Philadelphia Inquirer earlier this year as “a former Obama administration speechwriter” who had created a “Philly for Pete group” aimed at boosting former Democratic presidential primary candidate Pete Buttigieg. And the LGBTQ Victory Institute listed Osburn as a senior speechwriter for the Small Business Administration in an article praising the Obama-Biden administration for its LGBTQ hiring practices.

    “One of the people on an explosive email thread allegedly involving Hunter Biden has corroborated the veracity of the messages, which appear to outline a payout for former Vice President Joe Biden as part of a deal with a Chinese energy firm.

    One email, dated May 13, 2017, and obtained by Fox News, includes a discussion of “remuneration packages” for six people in a business deal with a Chinese energy firm. The email appeared to identify Hunter Biden as “Chair / Vice Chair depending on agreement with CEFC,” in an apparent reference to now-bankrupt CEFC China Energy Co.

    The email includes a note that “Hunter has some office expectations he will elaborate.” A proposed equity split references “20” for “H” and “10 held by H for the big guy?” with no further details. Fox News spoke to one of the people who was copied on the email, who confirmed its authenticity.

    Sources told Fox News that “the big guy” is a reference to the former vice president. The New York Post initially published the emails and other controversial messages that Fox News has also obtained.”

    There was also $3,300 for Joe Biden’s 2020 campaign and $2,100 for Hillary Clinton’s doomed 2016 presidential effort against Trump. Another $7,300 was contributed to the Democratic National Committee between 2004 and 2020.

    In 2012, Welker and her family celebrated Christmas at the White House with the Obamas.”

    Nothing at all.
    I don’t like Trump as a person, but he has been good as a President.
    We have nothing to choose between.
    This country is facing disaster as if there were nothing involved.
    We have an honest, effective president.
    We are challenged with corruption and self-enrichment.
    We know that.
    Yet, we are having a close election???

    Early voting data in battleground states shows Trump outpacing national polls giving Biden an edge

    The Republican Party is keeping pace in mail-in and early voting in three key swing states despite polls showing early voting should clearly favor Joe Biden.

    Data out of Michigan, Wisconsin, and Ohio indicates that registered Republicans are returning ballots at about the same rate as registered Democrats in the battleground states.

    In Michigan as of Wednesday, just over 1 million ballots have been returned, 40% from registered Democrats, with the same from registered Republicans. In Wisconsin, 40% of the 711,855 returned ballots have been from Democrats, while 38% have come from Republicans. The GOP actually leads in Ohio, with 45% of 475,259 early ballot returns coming from Republicans, compared to 43% from registered Democrats. The preliminary data matches up with the requests by party affiliation for mail-in ballots.

    The data contradicts national polls showing Biden supporters overwhelmingly plan to vote by mail or early in person. According to a Pew Research poll released Friday, 55% of voters who plan to cast their ballot in person before Election Day support Biden, compared to 40% who support President Trump.

    For a few weeks now, there has been a massive divide between what the polls say and what you can see happening on the ground. Every poll shows Biden leading, yet public support for Trump remains huge and enthusiastic.

    One other thing that’s not showing up in the polls and that’s favoring Trump is voter registration.
