    “The emergency motion for a TRO was filed today–the family is represented (for now) by a USC law professor. The motions for a TRO and a writ of habeas corpus are under seal on PACER.

    As is now custom, the Trump adm was not given a chance to respond before Judge Gallagher halted the removals.”

    Supreme Court decides all discrimination is equally bad.

  3. NJ — my point is Scalia advocated for due process to determine if immigrants were legal. If and when they were determined to be illegal, I’m sure he advocated for swift removal. The particular case being cited on the left side of the internet is Reno v Flores.

    As for the 11:03 post — due process and habeas corpus is something granted to the defendant not the plaintiff or executive.

    Chuck Schumer was probably referencing Jodi Ernst (R – Iowa) who responded to the criticism of the bill by stating, we are all going to die eventually. She later “apologised” from a cemetery — as an exercise in satire it was amusing
