  1. To be clear, they do have to agree on one crime, falsifying business records. But to make it a felony instead of a misdemeanor they also have to agree that he did it in the course of committing another crime. He’s not on trial for the other crime, so they have to agree only that he committed one in order for the falsifying to be considered a felony.

  2. Correction: they do not even have to agree that he committed another crime, only that he intended to do so. That’s what would make falsification of business records a felony.
