  2. Ordering Audit Of All FBI FISA Warrant Processes; Rips Ohr;

    https://hotair.com/archives/ed-morrissey/2019/12/09/horowitz-report-sufficient-predicate-crossfire-hurricane-probably-not-page-fisa-warrant/

“Horowitz concludes that the errors were so bad on the Page FISA applications that it indicts the entirety of FBI’s leadership:

That so many basic and fundamental errors were made by three separate, hand- picked teams on one of the most sensitive FBI investigations that was briefed to the highest levels within the FBI, and that FBI officials expected would eventually be subjected to close scrutiny, raised significant questions regarding the FBI chain of command’s management and supervision of the FISA process. FBI Headquarters established a chain of command for Crossfire Hurricane that included close supervision by senior CD managers, who then briefed FBI leadership throughout the investigation. Although we do not expect managers and supervisors to know every fact about an investigation, or senior officials to know all the details of cases about which they are briefed, in a sensitive, high-priority matter like this one, it is reasonable to expect that they will take the necessary steps to ensure that they are sufficiently familiar with the facts and circumstances supporting and potentially undermining a FISA application in order to provide effective oversight, consistent with their level of supervisory responsibility. We concluded that the information that was known to the managers, supervisors, and senior officials should have resulted in questions being raised regarding the reliability of the Steele reporting and the probable cause supporting the FISA applications, but did not. In our view, this was a failure of not only the operational team, but also of the managers and supervisors, including senior officials, in the chain of command.

For these reasons, we recommend that the FBI review the performance of the employees who had responsibility for the preparation, Woods review, or approval of the FISA applications, as well as the managers and supervisors in the chain of command of the Carter Page investigation, including senior officials, and take any action deemed appropriate.

At this point, one has to wonder why Horowitz doesn’t mention politics as one reason for the cascade of errors and violations, but an IG investigation isn’t necessarily robust enough in jurisdiction and scope to make that determination. It’s enough to get these violations on the record so that Congress can take up those issues. In this case, it’s likely that only the Senate will have enough interest in it, but that should be enough.”

“Update: Worth noting — Horowitz now wants to audit all of the FISA warrant processes at the FBI:

Accordingly, we have today initiated an OIG audit that will further examine the FBI’s compliance with the Woods Procedures in FISA applications that target U.S. persons in both counterintelligence and counterterrorism investigations. This audit will be informed by the findings in this review, as well as by our prior work over the past 15 years on the Department’s and FBI’s use of national security and surveillance authorities, including authorities under FISA, as detailed in Chapter One.

It might be better for the FBI if they find errors in other investigations. Otherwise, it might raise questions about why there were this many in the Page application.

Update: Of course, this might be all we need to know about Steele’s motives. Horowitz blisters Bruce Ohr for not following proper procedures about reporting his contacts with Steele and Fusion GPS’ Glenn Simpson, and includes what should have been included in the FISA warrant:”

  3. The bottom line…..

Trump was right, and Comey was a horrible “leader”.

    https://www.redstate.com/streiff/2019/12/09/bill-barr-gives-real-bottom-line-doj-ig-report/

“One of the the thing that Horowitz is crystal clear about is that the FBI fell far short of its duties and responsibilities in the investigation of the Trump campaign and that Department of Justice was simply not up to the task of managing the investigation on those occasions when the FBI even let them know what was going on. To say the least, Attorney General Bill Barr is not a happy man:”

    ————

“We an argue until the cows come home about all manner of trivia but the big picture is this: the FISA Court was lied to by the FBI. It was lied to knowingly and through negligence. Key leaders who were responsible for pushing the FISA warrant through on Carter Page were either pig ignorant of their legal responsibilities or they chose to ignore those responsibilities because they knew what FBI headquarters wanted done. None of this is a good look and I hope that Barr lights a fire under FBI Director Wray and makes him fix what is broken.

  4. Dems are in a hurry to impeach so they can get back to campaigning.

    https://nypost.com/2019/12/07/2020-candidates-in-senate-who-skip-impeachment-trial-could-face-arrest/

“2020 candidates in Senate who skip impeachment trial could face arrest”

“Sens. Elizabeth Warren, Bernie Sanders and other Senate Democrats running for president might find themselves pulled off the campaign trail for the trial of President Trump, or face arrest, a former Senate parliamentarian told The Post.

Should Democrats in the House of Representatives formally impeach the president — something that is widely expected by the end of the year — a January Senate trial is almost certain. The president’s fate would then be decided by a vote of 100 senators, with a two-thirds majority required for his removal.

The timing, however, couldn’t be worse for many of the party’s leading lights, who could be compelled to come off the campaign trail to sit for weeks just before voting begins.

“The senate collectively has the power to compel the attendance of absent senators and the Senate collectively acts by its majority and Mitch McConnell is the majority leader. So he has the ability,” former Senate parliamentarian Alan Frumin said. “If push comes to shove, compelling means arresting. ”

It could even mean sending the chamber’s Sergeant at Arms to Iowa to collect truant senators if need be, said Frumin, who spent 19 years in the position and is one of the foremost experts in the rules and procedures of the body.

While Democratic senators might ordinarily relish their Constitutional obligation to sit in judgment over the polarizing billionaire, the trial couldn’t come at a worse time in the 2020 Democratic primary calendar. The Iowa caucuses are Feb. 3, with the New Hampshire primary coming just eight days later. South Carolina and Nevada will follow before the month is out. The candidates have invested millions of dollars in the states, and many have pinned their future on strong showings.

“If we expect the Senate trial to happen in January then that will necessarily take many of these Democrats running for president off the campaign trail to act as jurors. That is a fact,” Antonia Ferrier, a former McConnell spokeswoman told The Post.”

  6. This is bad.

And as I said for weeks now, these people and their “expertise” are suspect at best. These “leaders” lie and manipulate to bend public opinion to their will.

The whole Trump fiasco proves this, but here’s even more evidence. And this covers multiple admins from both parties. This is on the “experts” more than the presidents. This is the danger of listening to those who wage war for a living. Of course waging war is their solution to everything.

Wanna know why Trump wants us out of Afghanistan? Because lives have been wasted, for nothing.

    https://www.msn.com/en-us/news/world/confidential-documents-reveal-us-officials-failed-to-tell-the-truth-about-the-war-in-afghanistan/ar-BBXY8l1

“Confidential documents reveal U.S. officials failed to tell the truth about the war in Afghanistan”

“A confidential trove of government documents obtained by The Washington Post reveals that senior U.S. officials failed to tell the truth about the war in Afghanistan throughout the 18-year campaign, making rosy pronouncements they knew to be false and hiding unmistakable evidence the war had become unwinnable.

The documents were generated by a federal project examining the root failures of the longest armed conflict in U.S. history. They include more than 2,000 pages of previously unpublished notes of interviews with people who played a direct role in the war, from generals and diplomats to aid workers and Afghan officials.

The U.S. government tried to shield the identities of the vast majority of those interviewed for the project and conceal nearly all of their remarks. The Post won release of the documents under the Freedom of Information Act after a three-year legal battle.

In the interviews, more than 400 insiders offered unrestrained criticism of what went wrong in Afghanistan and how the United States became mired in nearly two decades of warfare.

With a bluntness rarely expressed in public, the interviews lay bare pent-up complaints, frustrations and confessions, along with second-guessing and backbiting.

“We were devoid of a fundamental understanding of Afghanistan — we didn’t know what we were doing,” Douglas Lute, a three-star Army general who served as the White House’s Afghan war czar during the Bush and Obama administrations, told government interviewers in 2015. He added: “What are we trying to do here? We didn’t have the foggiest notion of what we were undertaking.”

“If the American people knew the magnitude of this dysfunction . . . 2,400 lives lost,” Lute added, blaming the deaths of U.S. military personnel on bureaucratic breakdowns among Congress, the Pentagon and the State Department. “Who will say this was in vain?”

Since 2001, more than 775,000 U.S. troops have deployed to Afghanistan, many repeatedly. Of those, 2,300 died there and 20,589 were wounded in action, according to Defense Department figures.

The interviews, through an extensive array of voices, bring into sharp relief the core failings of the war that persist to this day. They underscore how three presidents — George W. Bush, Barack Obama and Donald Trump — and their military commanders have been unable to deliver on their promises to prevail in Afghanistan.”

With most speaking on the assumption that their remarks would not become public, U.S. officials acknowledged that their warfighting strategies were fatally flawed and that Washington wasted enormous sums of money trying to remake Afghanistan into a modern nation.

The interviews also highlight the U.S. government’s botched attempts to curtail runaway corruption, build a competent Afghan army and police force, and put a dent in Afghanistan’s thriving opium trade.

The U.S. government has not carried out a comprehensive accounting of how much it has spent on the war in Afghanistan, but the costs are staggering.”

  7. Oh, and also buried in the IG report is something we already knew. John Brennan lied to Congress and the American people.

“Cuz that’s what lying hacks like him do.

    https://thefederalist.com/2019/12/09/brennan-lied-about-not-including-steele-dossier-in-intelligence-community-assessment-on-2016-russian-election-interference/

“Brennan Lied About Not Including Steele Dossier In Intelligence Community Assessment On 2016 Russian Election Interference”

“The new report from Department of Justice Inspector General Michael Horowitz confirmed former CIA Director John Brennan lied to Congress about whether the dossier authored by Christopher Steele was used in the Obama administration’s Intelligence Community Assessment (ICA).”

    ————

“Ultimately, the ICA included a short summary and assessment of the dossier, which was incorporated in an appendix. “In the appendix, the intelligence agencies explained that there was ‘only limited corroboration of the source’s reporting’ and that Steele’s election reports were not used ‘to reach analytic conclusions of the CIA/FBI/NSA assessment,’” the IG report states.

A few months later, on May 23, 2017, when testifying before the House Permanent Select Committee on Intelligence, Brennan categorically denied that the CIA relied on the Steele dossier for the ICA report. Here is the full exchange with former Rep. Trey Gowdy:

Mr. Gowdy: Do you know if the Bureau ever relied on the Steele dossier as any — as part of any court filings, applications, petitions, pleadings?

Mr. Brennan: I have no awareness.

Mr. Gowdy: Did the CIA rely on it?

    Mr. Brennan: No.

    Mr. Gowdy: Why not?

Mr. Brennan: Because we — we didn’t. It wasn’t part of the corpus of intelligence information that we had. It was not in any way used as a basis for the Intelligence Community assessment that was done. It was — it was not.

Brennan claimed the unverified dossier was not “part of the corpus of intelligence information we had.” On page 179 of the IG report, IG investigators asked former FBI Director James Comey if he remembered discussions with Brennan on presenting the dossier to Obama. Comey said Brennan and other officials argued it was “important” enough to include in the ICA — clearly part of the “corpus of intelligence information” they had.”

Family of Josh Watson, Pensacola attack hero, calls for arming service members on military bases

    https://www.foxnews.com/media/family-josh-watson-pensacola-florida-attack-navy-hero-second-amendment

“The family of one of the three heroic sailors who lost their lives in last week’s Naval Air Station (NAS) shooting in Pensacola, Fla., is calling for reform on military bases.

Naval Academy graduate Joshua Watson, 23, of Enterprise, Ala., was shot at least five times by a Saudi national but still made it outside to alert the First Response team to the shooter’s identity and location.

Appearing on “Fox & Friends” Tuesday with hosts Steve Doocy, Ainsley Earhardt and Brian Kilmeade, Watson’s family said that their son was a marksman and they believe the situation would have turned out differently had he been allowed to have a service weapon on the base.”

  11. Lie to the FBI, you get charged.

So what happens now that it’s the other way around, and it’s the FBI that’s been lying, even to themselves?

    https://legalinsurrection.com/2019/12/if-you-were-as-deceptive-with-the-fbi-as-the-fbi-was-with-the-fisa-court-how-quickly-would-you-be-charged/

“As with his prior report on FBI Director James Comey’s leaking of information, Horowitz provided a headline version allowing Comey and others to declare exoneration because no criminal referral, while the details were devastating.”

And the details were devastating, as John Solomon catalogs, Just how bad was the FBI’s Russia FISA? 51 violations and 9 false statements:

To understand just how shoddy the FBI’s work was in securing a Foreign Intelligence Surveillance Act warrant targeting the Trump campaign, you only need to read an obscure attachment to Justice Department Inspector General Michael Horowitz’s report.”

    —-

“A whopping nine of those violations fell into the category called: “Supporting document shows that the factual assertion is
    inaccurate.”

For those who don’t speak IG parlance, it means the FBI made nine false assertions to the FISA court. In short, what the bureau said was contradicted by the evidence in its official file.

Solomon then makes the key point:

To put that in perspective, former Trump aides Mike Flynn and George Papadopoulos were convicted of making single false statements to the bureau. One went to jail already, and the other awaits sentencing.

The FBI made nine false statements to the court.

    So the question is:

If you were as deceptive with the FBI, as the FBI was with the FISA court, how quickly would you be charged?

    The answer is:

Pretty damn fast, and pretty damn hard.

Hopefully the statements issued by John Durham and Bill Barr reflect that the FBI officials behind this will be treated the way the FBI treats others.”
